Complaint to the Croatian Securities
Commission regarding irregularities in trading of ZABA shares,
of
23.3.2004; the following is indicated:
1. That the ZABA Share Register has been falsified,
2. That the number of ZABA shares was increased without a
matching increase in the capital of the bank,
3. That legally issued shares of legal shareholders were
subsequently erased,
4. That there is no proof of ZABA ever having been privatized,
5. That the total capital of the Consortium members UNICREDITO
ITALIANO/ALLIANZ - which allegedly acquired ZABA, disputable in
the percentage in which ZABA capital participates in the total
capital of the Consortium banks,
6. That the
plaintiff has applied to various appropriate Croatian
institutions, and that only the President of Croatia reacted
with inquiries to the Croatian Privatization Fund and the
Croatian National Bank, of which the former declared itself "not
competent" while the latter has avoided answering the President
of the Republic of Croatia.
